Removal (Deportation) Defense
Immigration court can be frightening.
The stakes are high, and losing can mean being removed from your family and life in the United States. These cases can be complicated, and the legal landscape has been constantly changing in the last few years.
Data show that having a skilled attorney representing you in removal proceedings significantly increases your chances of success.
A 2016 study by the American Immigration Council found that immigrants with attorneys fared better at every stage of removal proceedings.
Detained immigrants with lawyers were four times more likely to be released than those who were unrepresented.
Among detained immigrants, those with representation were twice as likely as unrepresented immigrants to obtain immigration relief they sought, while non-detained immigrants with lawyers were five times more likely to win their cases than those without lawyers.
At Pelton + Balducci, we know what’s at stake and work hard to protect our clients. As a result, we have prevented deportation/removal and obtained status for many individuals in removal proceedings, including those facing serious allegations.
Common Grounds for Deportation
No immigrant can be removed from the United States without a specific reason, and they will also be granted due process of law, which includes a hearing before an immigration judge.
The judge will review the evidence and determine whether the immigrant violated immigration law.
Common grounds for deportation proceedings include:
- Criminal convictions (such as aggravated felonies, domestic violence, and crimes that have been classified as “crimes involving moral turpitude”)
- Unlawful or fraudulent entry into the U.S. or other immigration violations such as visa overstay
- Visa or immigration status expiration
- Referral by USCIS of denied application for benefit such as asylum or lawful permanent resident status
- Employment violations
- Drug or weapons: possession and trafficking
Other reasons for removal from the United States might include someone running away from an immigration checkpoint, someone accused of a sham marriage for the purposes of immigration, someone who assisted in human smuggling into the United States, or any number of violations.
Deportation cases can be complex, which is why it is so important to have proper legal representation.
Our job is to work with you on your immigration case to find the best defense strategy that will allow you to feel confident that your case is in good hands.
Types of Defenses
Our team has extensive experience working with immigrants to avoid removal and continue living their lives in the United States.
These cases include:
- Successfully litigating applications for cancellation of removal, asylum, adjustment of status, and the removal of conditions in removal proceedings.
- Successfully filing appeals and securing status for individuals who previously had removal orders.
- Successfully reopening cases to rescind final removal orders.
- Regularly assisting individuals in removal proceedings and acquiring status through forms of relief filed with USCIS (e.g., U visas and DACA), which then result in termination of the immigration court proceedings.
- Successfully filing mandamus actions, in which the government agencies have unduly delayed adjudication of immigration applications.
