Removal (Deportation) Defense

Immigration court can be frightening.

A 2016 study by the American Immigration Council found that immigrants with attorneys fared better at every stage of removal proceedings. 

Detained immigrants with lawyers were four times more likely to be released than those who were unrepresented.

Among detained immigrants, those with representation were twice as likely as unrepresented immigrants to obtain immigration relief they sought, while non-detained immigrants with lawyers were five times more likely to win their cases than those without lawyers.

Common Grounds for Deportation

No immigrant can be removed from the United States without a specific reason, and they will also be granted due process of law, which includes a hearing before an immigration judge.

The judge will review the evidence and determine whether the immigrant violated immigration law. 

Common grounds for deportation proceedings include:

  • Criminal convictions (such as aggravated felonies, domestic violence, and crimes that have been classified as “crimes involving moral turpitude”)
  • Unlawful or fraudulent entry into the U.S. or other immigration violations such as visa overstay
  • Visa or immigration status expiration
  • Referral by USCIS of denied application for benefit such as asylum or lawful permanent resident status
  • Employment violations
  • Drug or weapons: possession and trafficking

Other reasons for removal from the United States might include someone running away from an immigration checkpoint, someone accused of a sham marriage for the purposes of immigration, someone who assisted in human smuggling into the United States, or any number of violations.
